Welcome to the Trendex Terms and Conditions. These Trendex Terms and Conditions govern all purchases and use of the Trendex Online Shop. By accessing www.trendex.co.za (the “Website”), whether as a visitor or a registered User (the “User” or the “Customer”), you agree to be bound by these specific Trendex Terms and Conditions.

1. Registration and Eligibility

Age Requirement: You may only purchase goods from this Website if you are 18 years of age or older.
Account Security: To purchase products from our Smartphones Collection, you must be a registered User. You are responsible for maintaining the confidentiality of your login details. Trendex shall take all reasonable steps to protect your information as detailed in our Trendex Privacy Policy.

2. Agreement of Sale Under Trendex Terms and Conditions

Binding Contract: An Agreement of Sale only comes into effect once you have electronically submitted a successful order and payment has been authorized and received in full by Trendex.
Shopping Baskets: Placing a product in a shopping basket does not constitute an order. Trendex cannot be held liable if products in your basket are no longer available during checkout.

3. Pricing, Products, and Availability

VAT Inclusive: All prices displayed for our Unboxed Tech and new devices are inclusive of VAT.
Accuracy: While we strive for 100% accuracy in our Trendex Terms and Conditions, should an item be ordered and Trendex is unable to fulfill the order due to technical errors, our liability is limited to a full refund.

4. Discount Offers and Vouchers

Application: Voucher codes must be entered at the checkout stage. Unless stated otherwise, voucher codes cannot be combined with other sales or “Was/Now” pricing.

5. Specialized Trendex Terms and Conditions for RICA & TV Licenses

5.1 SIM Card Activation and RICA

Compliance: In terms of the Regulation of Interception of Communications (RICA), customers must register their SIM cards.
Verification: You must present an original ID/Passport and Proof of Residence to the courier for verification.

5.2 Television Licenses

Legal Requirement: In accordance with the Broadcasting Act, Trendex requires a valid South African TV license for any television purchase. We will verify the license with the SABC before dispatching.

6. Delivery, Risk, and Ownership

Risk: All risk of loss or damage passes to the Customer upon delivery. Ownership remains with Trendex until full payment is received.

7. “Peace of Mind” Returns and Refunds

Satisfaction Guarantee: If you are not completely satisfied, you may return it for a full refund within 7 days of receipt, provided the product is in its original, unopened packaging.
Usage Charges: Trendex reserves the right to levy a restocking fee of up to 25% if the product is returned with opened packaging.

8. Warranty and Listing (Blacklisting)

Manufacturer Warranty: All new products carry standard warranties. Our “Unboxed” range includes a Trendex-backed local warranty.
Theft or Loss: Trendex can assist in “blacklisting” lost or stolen cellular phones on local networks, provided all required documentation is supplied.

9. Disclaimer and Limitation of Liability

“As Is”: The Website is supplied on an “as is” basis. Trendex makes no warranties that the Website will be uninterrupted or error-free. Accessing third-party links is done at your own risk.

10. Governing Law and Jurisdiction

These Trendex Terms and Conditions are governed by South African law. Any disputes shall be subject to the jurisdiction of the South African courts or submitted to confidential arbitration in Johannesburg under the rules of the Arbitration Foundation of South Africa (AFSA).
